By accessing and using the services of Storypitch.ai (the “Service”), you are agreeing to be bound by these Terms of Service. If you do not agree with these terms, please do not access or use our Service.

Our Service

Storypitch.ai offers an AI-based storytelling service for startups. We craft narratives based on your input, and these are further refined by our team of experts if the plan you chose allows it. Please note that as of the effective date of these Terms of Service, our Service is only available in English. Any content delivered will be provided solely in English. We do not currently offer services in other languages.

Account Registration

To use our Service, you may be required to create an account. You must provide accurate information and keep your account secure. You are responsible for any activity that occurs under your account. The service is not intended for use by individuals under the age of 18.

Use of Service and Usage Restrictions

You agree to use the Service for lawful purposes only. You are prohibited from using the Service for any illegal activities, violating others’ intellectual property rights, or attempting to disrupt or hack the Service. Any misuse of the Service, as determined by Storypitch.ai, may result in your account being suspended or terminated. In the event of termination, you will lose access to any content, data, and other information related to your account. Storypitch.ai reserves the right to limit or block access to the Service under certain circumstances at its sole discretion.

Payment and Refunds

Our Service is provided on a fee basis. You agree to pay the fees as specified on our website at the time of purchase. All sales are final, and we do not offer refunds for any reason.

Proration and Credits (Generations) Transfer

Please note that no proration or credits transfer is possible between founder bundles and agency plans. Each plan operates independently, and any unused generations or benefits under one plan cannot be transferred to or applied toward another plan.

Credits (Generations) Expiry

Generations included in the founder bundles (Starter, Storyteller, and Strategist) do not expire and can be used at any time, provided your account remains active and in good standing. The availability of these generations is contingent upon the continued operation of Storypitch.ai. If our platform or company ceases operations or undergoes significant changes that make the continuation of these plans unsustainable, we reserve the right to terminate the plans and discontinue associated benefits. By purchasing a founder bundle, you acknowledge and agree that its validity is subject to the terms of service. Unused generations are not refundable. We encourage users to periodically review our Terms of Service for any updates or changes regarding these plans.

Lifetime Access

The founder bundles, marketed as “lifetime” bundles, depend on the continued operation of Storypitch.ai. If our platform or company ceases operations or undergoes significant changes that make the “lifetime” bundles unsustainable, we reserve the right to terminate the bundles and discontinue associated benefits. By purchasing a “lifetime” bundle, you acknowledge and agree that its validity is subject to the operational status of our platform and the terms of service. We encourage users to periodically review our Terms of Service for any updates or changes regarding the “lifetime” bundles.

Intellectual Property

All content produced by Storypitch.ai remains the intellectual property of Storypitch.ai until the service fee has been paid in full. Once payment has been received, the intellectual property rights will be transferred to you for all jurisdictions and all purposes, unless otherwise specified. You are responsible for protecting your rights in the content once it has been delivered.

Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available”. We disclaim all warranties and conditions of any kind, either express or implied. Storypitch.ai is not liable for any direct or indirect damages arising from your use of the Service. Our service may contain links to third-party websites or services, we assume no responsibility for the content or practices of these services.

Force Majeure

Storypitch.ai is not liable for any failure to perform its obligations where such failure is a result of acts of nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout, or any interruption or any failure of electricity or server, system, computer, internet, or telephone service.

Changes to the Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any changes, and your continued use of the Service after such changes constitutes your acceptance of the new terms.

Indemnification

You agree to indemnify and hold Storypitch.ai, its affiliates, officers, directors, employees, agents, and partners harmless from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service and your violation of these Terms of Service.

Dispute Resolution

Any disputes arising out of these Terms will be resolved in accordance with the laws of the state of Wyoming, United States. This includes disputes resolved through mandatory arbitration and does not involve a court or a jury.
